Maintenance Orders (Facilities For Enforcement) Act.

The Maintenance Orders (Facilities for Enforcement) Act facilitates the enforcement of maintenance orders made in reciprocating countries in Zimbabwe, and vice versa. It establishes a framework for cross-border cooperation in enforcing maintenance obligations.

Key Provisions:

1. Enforcement of Foreign Maintenance Orders:

   • A certified copy of a foreign maintenance order can be registered in a Zimbabwean maintenance court.
   • Once registered, the order can be enforced in Zimbabwe using the same procedures as domestic maintenance orders.

2. Transmission of Zimbabwean Orders:

   • Zimbabwean courts can transmit maintenance orders to reciprocating countries for enforcement.

3. Provisional Orders:

   • Zimbabwean courts can make provisional maintenance orders against individuals residing in reciprocating countries.
   • These orders require confirmation by a court in the reciprocating country.

4. Confirmation of Foreign Orders:

   • Zimbabwean courts can confirm foreign provisional maintenance orders.

The Act ensures that individuals who have maintenance obligations in one country can be held accountable in another, promoting fairness and justice for dependents.
