Child Abduction Act

This Act implements the Hague Convention on the Civil Aspects of International Child Abduction in Zimbabwe. It provides a legal framework to:

  • Secure the prompt return of children wrongfully removed or retained to or in Zimbabwe.
  • Protect rights of custody and access under the law of one Contracting State in other Contracting States.

  • Central Authority: Designates the Secretary as the Central Authority responsible for handling child abduction cases.
  • Judicial Authority: The High Court has jurisdiction over matters related to the Convention.
  • Interim Powers: The High Court can issue interim orders to protect the child's welfare.
  • Declaratory Orders: The High Court can declare the wrongful removal or retention of a child.
  • Proof of Foreign Decisions: Outlines procedures for admitting foreign court decisions and determinations.
  • Costs of Applications: Addresses the issue of costs related to applications under the Convention.

The Act incorporates the provisions of the Hague Convention, ensuring that Zimbabwe complies with international standards for child abduction cases.
